New laws for your business

The Employment (Allocation of Tips) Act comes into effect on 1st October 2024. The legislation applies to ’employer-received’ tips – i.e. tips paid by card.

In the event of non-compliance, qualifying staff are entitled to bring a claim against the business in an Employment Tribunal. The tribunal has the power to enforce compensation payments of up to £5,000.

If a business is found guilty of not paying appropriate taxes then they could be prosecuted for tax evasion with unlimited fines and up to seven years in jail.

Does this comply with UK tipping laws?

Yes, Since tips will go directly from your clients to your employees without hitting your business account, you won’t need to worry about the UK’s tipping laws (The Employment (Allocation of Tips) Act 2023,)  – you’ll be 100% compliant.

Does this cost extra?

What happens when a tip is split between staff?

Tips are split equally between the staff members on the bill who perform a service. E.g if Abbie and Mike do a colour and a cut and your receptionist sells a shampoo and the client leaves a £10 tip, Abbie and Mike will receive £5 each, your receptionist will not receive a tip due to only selling retail.
